United States Supreme Court: Death Penalty Case Law

Furman v. Georgia, 408 U.S. 238 (1972) : Landmark case wherein five justices concluded that the death penalty was unconstitutional in its application. The opinion led to a moratorium in death sentences while states adopted new laws designed to provide guidance and reason to a system of capital punishment that was arbitrary and capricious.
